Leeds Mental Health Trust has recently been issued enforcement notices under the Regulatory Reform Order.

The Trust and Accent Group ltd, the property managers of the trust have been informed that fire safety precautions must be improved within the hospital following the death of a patient after he suffered serious burns at the hospital.

The investigation into the individual's death is ongoing, however the enforcement notices issued by West Yorkshire Fire Service highlight the importance of these notices.

The Accent Group designed and built the centre where the incident took place and is therefore partly responsible for the catalogue of safety failings.

Concerns included the evacuation measures, fire fighting/protection equipment and fire prevention.

The Environment and Safety Information Act imposes a statutory duty on authorities responsible for issuing notices under the regulatory reform order to maintain a public register of notices served where these notices are classed as being 'relevant notices'.

In this respect, 'relevant notices' are those served under any of the provisions of the Regulatory Reform Order.

The notices served to the trust are classed as 'relevant notices' and as such must be entered into the register stating sufficient particulars to convey the substance of each notice to which it relates.

The trust states:

'The trust always puts the safety of patients and staff first and is constantly seeking ways to improve the safety of its facilities.

These notices do not mean that our facilities are unsafe but do suggest a number of improvements'.

Since the enforcement notices were issued last April following this tragic incident, the trust has been working with West Yorkshire Fire and Rescue and the Accent Partnership to take the necessary steps to comply to all requirements
